Job Summary

Plans, organizes, and manages Metro′s HEAR (Helping Employees Access Resources) Program, including the Americans with Disabilities Act (ADA) Interactive Process, to ensure that employee complaints are addressed at the lowest possible level and to contribute to a culture in which employees are heard and treated with respect.

Duties and Responsibilities
  • Plans and manages Metro′s HEAR Program, including the ADA Interactive Process, to ensure compliance with Americans with Disabilities Act (ADA) and the California Fair Employment and Housing Act (FEHA)
  • Manages the development and implementation of strategies, goals, budgets, policies, and procedures for Metro′s HEAR Program
  • Receives and reviews employee issues and/or concerns, such as complaints and disputes arising from employment with Metro, and investigates and/or refers the matter to the appropriate department
  • Conducts investigations into alleged violations of human resources and administrative policies and procedures
  • Facilitates meetings with management and assigned staff to review, discuss, and mediate issues/ conflicts; makes good faith effort to resolve matters
  • Develops and coordinates responses to complaints and issues with the appropriate department
  • Provides advise and makes recommendations on disciplinary matters, up to and including termination of an employee
  • Maintains case files and protects confidential information
  • Manages stakeholder round table meetings to ensure the organization utilizes comprehensive and legally sound approaches to problem solving
  • Serves as lead for the agency′s Threat Management Team and administers the violence prevention policy, as well as other agency-wide violence prevention programs
  • Reviews and analyzes requests for violence threat assessments and makes recommendations based on applicable laws, internal policies, and guidelines
  • Develops and implements training programs regarding subjects such as employment policies, bullying, and harassment
  • Advises management and staff on Metro′s relevant policies on discrimination, harassment, and grievances
  • Works on special projects to assist management with confidential and sensitive issues relating to employees
  • Oversees a Disability Compliance team; supervises, trains, mentors, and motivates assigned staff
  • Complies with Metro′s efficient and effective bill paying standard to ensure project and cost center invoices are paid in a timely manner
  • Oversees, monitors, and adheres to department/unit budget, goals, and schedules which comply with agency-wide fiscal responsibility
  • Develops and delivers quality projects from inception to close-out on time and within scope and budget
  • Communicates and implements safety rules, policies, and procedures in support of the agency's safety vision and goals; and maintains accountability for the safety performance of all assigned employees
  • Contributes to ensuring that the Equal Employment Opportunity (EEO) policies and programs of Metro are carried out

Minimum Qualifications

A combination of education and/or experience that provides the required knowledge, skills, and abilities to perform the essential functions of the position. Additional experience, as outlined below, may be substituted for required education on a two-for-one year  basis. A typical combination includes:

Education

  • Bachelor's Degree in Public Administration, Employee Relations, or a related field; Master′s Degree in a related field preferred and/or Juris Doctor degree (JD) with focus on Employment Law preferred


Experience

  • Six years of relevant experience or three years of relevant supervisory-level experience working in an employment law, employee/labor relations, or human resources function handling employee complaints, grievances, and personnel issues and making appropriate investigations and recommendations; some positions in this class may require specialized experience in area of assignment


Certifications/Licenses/Special Requirements

  • A valid California Class C Driver License or the ability to utilize an alternative method of transportation when needed to carry out job-related essential functions
  • Licensed Attorney or Paralegal certification with focus on Employment Law preferred
